1. Introdução

Este Aviso de Privacidade (“Aviso”) foi criado para demonstrar nosso compromisso em sempre tratar seus dados pessoais com segurança, privacidade e transparência. Ele descreve os dados pessoais que coletamos quando você acessa nosso site nu.co (“Site”) e os compartilha conosco, bem como a forma como seus dados são usados, armazenados e compartilhados, e quais direitos você tem sobre tais dados.

2. Aplicação

Este Aviso é aplicável a qualquer pessoa que visite nosso Site e se inscreva em nossa lista de espera, incluindo, mas não se limitando a, indivíduos que prospectamos como potencialmente interessados em nossos serviços (“Serviços”), ou que se candidatam a entrar em nossa lista de espera.

• are 18 years of age or older at the time of registration;
• possess a valid government-issued photo identification document that will be required for entry on-site;
• are not employees, contractors, or agents of Nu or Mercedes who are attending the Event in a professional capacity (unless separately authorised by Nu or Mercedes); and
• provide accurate, complete, and truthful information in the registration form.

By registering, you represent and warrant that you meet all eligibility requirements. Nu reserves the right to disqualify any registration that does not comply with these requirements.

3. Coleta de dados pessoais

Individuals who are not selected to receive a confirmed time-slot will not be entitled to entry, compensation, or any other benefit solely by reason of having registered. Only one entry per eligible customer.

Important: A confirmed time-slot invitation will be communicated to selected registrants via the email address provided at registration. You must receive and retain your confirmation to gain entry. Invitations are personal and non-transferable.

No purchase is necessary to receive a time slot allocation and a purchase will not improve chances of receiving a time slot allocation. Void where prohibited.

4. Compartilhamento de dados pessoais

• Zip Code — used for segmentation and campaign analytics.

Any processing of your personal data by Nu related to House of Nu will be carried out under Nu's Privacy Notice.

Your personal data will be processed by Nu and may be shared with authorised service
providers, marketing partners (including Mercedes, based on your consent), and event
operations vendors, each bound by appropriate data protection obligations.

Nu will retain your personal data for as long as necessary to fulfil the purposes described above and as required by applicable law. For full details, please refer to Nu's Privacy Notice.

By registering, you also acknowledge that photography, video recording, and other media capture may take place on-site at House of Nu. Please refer to Section 11 (Photography and Media) below.

6. Transferência internacional de dados

• Visitors must treat Nu and Mercedes staff, other visitors, and the physical installations
  with respect at all times.
• Any form of harassment, threatening behaviour, discrimination, or violence will result in immediate removal from the premises and may result in referral to law enforcement authorities.
• Visitors must not touch, tamper with, or attempt to remove any memorabilia, equipment, or Nu/Mercedes branded items from the venue (other than co-branded merchandise issued as part of the experience).
• Consumption of alcohol (where provided) is subject to applicable Florida law. Visitors
  who appear intoxicated may be refused entry or removed.
• Smoking, vaping, and the use of illegal substances are strictly prohibited on the
  premises.
• Visitors must follow all instructions given by Nu staff and venue security personnel.

Nu reserves the right, at its sole discretion, to refuse entry to or remove any visitor who
breaches these conduct standards, poses a health or safety risk, or otherwise acts in a manner inconsistent with these Terms. No compensation or alternative access will be provided in such circumstances.

8. Retenção e exclusão de dados pessoais

House of Nu features interactive digital installations and augmented-reality experiences. Visitors with photosensitive epilepsy or other conditions that may be triggered by flashing lights or immersive visual environments should exercise caution and consult a medical professional before attending. Nu accepts no liability for adverse health reactions arising from the experiential elements of the activation.

The venue is located in Wynwood, Miami. Visitors are responsible for their own transportation to and from the venue. Nu accepts no responsibility for any incidents occurring outside the premises of House of Nu.

If you require specific accessibility accommodations, please contact info@teama21.com at least 72 hours before your confirmed time-slot. Nu will make reasonable efforts to accommodate requests subject to venue constraints.

• reproduce or publish Nu or Mercedes branding in any commercial context without prior written authorization;
• use photographs or videos taken at House of Nu to misrepresent any association,
  sponsorship, or endorsement between yourself or any third party and Nu or Mercedes;
  or
• remove, deface, or alter any Nu or Mercedes branding on merchandise or materials.

11. Photography, Video, and Media Consent

House of Nu is a brand activation space. Photography and video recording by Nu's or
Mercedes’s appointed photographers and videographers will take place throughout the Event Dates for marketing, public relations, and archival purposes

By attending, you grant Nu and Mercedes an irrevocable, royalty-free, worldwide licence to use your image, likeness, and voice as captured in photographs, videos, or other media taken at House of Nu for marketing and promotional purposes across all channels and media formats, including without limitation digital advertising, social media, press releases, and future event promotion.

If you object to having your image used for promotional purposes, please notify a Nu staff member upon arrival. If you object to having your image used for promotional purposes after the event, please refer to Nu's Privacy Notice for contact information. Nu will make reasonable efforts to accommodate such requests, but cannot guarantee the complete exclusion of your image from all materials given the nature of an open experiential space.

Visitors may take personal photographs and videos for non-commercial purposes. Any visitor content featuring Nu or Mercedes branding or memorabilia is subject to the intellectual property restrictions in Section 10.

12. Financial Services — Regulatory Disclosures

House of Nu is a marketing and brand experience. It does not constitute the provision of
financial advice, an offer to provide financial services, or an invitation to apply for any Nu
financial product. Eligibility for Nu products and services is determined separately and is not guaranteed by attendance at or registration for House of Nu.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

• Nu and Mercedes make no representations or warranties regarding the continuity,
  availability, or fitness for any particular purpose of the House of Nu experience.
• Nu and Mercedes shall not be liable for any indirect, incidental, special, consequential,
  or punitive damages arising from or connected to your registration, attendance, or
  non-attendance at House of Nu, including without limitation loss of enjoyment, loss of
  time, travel costs, or any costs associated with non-selection.
• Nu's total aggregate liability to any individual visitor for direct loss arising from or
  connected to these Terms shall not exceed one U.S dollar ($1.00).

14. Cancellation, Modification, and Force Majeure

Nu reserves the right to:

• modify the dates, times, location, or content of House of Nu at any time and without
  liability;
• cancel House of Nu in whole or in part if required; and
• amend these Terms at any time. Material changes will be communicated to registered
  participants via the email address on record.

In the event of cancellation, Nu's sole obligation will be to notify confirmed visitors via email. No compensation, refund, or alternative access shall be due, as no monetary consideration is charged to visitors.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of
Delaware, United States, without regard to its conflict of laws provision.

Any dispute, claim, or controversy arising out of or relating to these Terms, your registration of interest, or your attendance at House of Nu, including any question as to the existence, validity, or termination of these Terms (each, a "Dispute"), shall be finally resolved by binding arbitration rather than in court, except as set out below.

Forum and Rules. Nu shall designate the arbitral institution and the rules under which the
arbitration will be conducted ("Arbitration Rules"), provided that the designated institution is a recognised international or domestic arbitration body. Nu will notify the claimant of the designated institution and rules at the time it receives or files the notice of arbitration. The Arbitration Rules of the designated institution are incorporated by reference and shall govern the conduct of the proceedings, except to the extent they conflict with these Terms, in which case these Terms prevail.

Seat and Language. The seat of arbitration shall be Miami, Florida, United States. Proceedings shall be conducted in English.

Arbitrator. The arbitration shall be conducted before a sole arbitrator appointed in accordance with the Arbitration Rules of the designated institution.

Governing Law. The arbitrator shall apply the substantive law of the State of Delaware, without regard to its conflict of laws provisions.

Costs. Each party shall bear its own legal fees and costs. Arbitration filing fees and arbitrator compensation shall be allocated in accordance with the Arbitration Rules of the designated institution, except that Nu shall not seek recovery of its arbitration costs against any individual visitor whose claim does not exceed five-hundred U.S. dollars ($500.00).

Confidentiality. The existence of the arbitration, all submissions, and the award shall be kept strictly confidential by both parties, except as required by law or to enforce an award.

Emergency and Interim Relief. Either party may seek emergency or interim relief from a court of competent jurisdiction in Miami-Dade County, Florida, without waiving the right to arbitrate the underlying Dispute.

Class Action Waiver. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL
DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY
RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR
REPRESENTATIVE PROCEEDING. The arbitrator has no authority to consolidate claims or
preside over any form of class or representative proceeding.

Exceptions. The following are not subject to arbitration and may be brought before the state or federal courts of Miami-Dade County, Florida: (i) claims for injunctive or other equitable relief to protect intellectual property rights; (ii) small claims court actions within applicable jurisdictional limits; and (iii) claims that applicable law expressly requires to be resolved in court.

16. General Provisions

Severability: If any provision of these Terms is found to be invalid or unenforceable, it shall be modified to the minimum extent necessary to make it valid and enforceable. All other provisions shall remain in full force.

Entire Agreement: These Terms, together with Nu's Privacy Policy, constitute the entire
agreement between you and Nu with respect to your registration of interest and attendance at House of Nu, and supersede all prior representations, understandings, or agreements.

No Waiver: Failure by Nu to enforce any provision of these Terms shall not constitute a waiver of its right to do so at a later date.

Language: These Terms are provided in English. In the event of any conflict between an
English version and a translation, the English version shall prevail.

Third-Party Rights: Except as expressly stated, these Terms do not confer rights on any third party.

ACCEPTANCE

By checking the acceptance box and submitting the House of Nu registration form, I confirm that:

• I am 18 years of age or older;
• I have read and understood these Terms and Conditions in full;
• I agree to be bound by these Terms;
• I consent to the processing of my personal data as described in Section 5; and
• I understand that registration does not guarantee access to House of Nu and that
  confirmed time-slot invitations are subject to availability and Nu's sole discretion.
